Terms & conditions
These terms apply to all hires with Hyndburn Hire. Please read them before paying — paying for a booking or taking delivery means you accept them.
1. Who we are
Hyndburn Hire Ltd (trading as Hyndburn Hire), company number 17448362, registered in England & Wales, and based in Accrington, Hyndburn. Contact us on 07494 086162 or via the enquiry form on this website. References to "We", "us" and "Our" mean Hyndburn Hire Ltd.
2. Bookings and quotations
Quotations are valid for 14 days and are based on the hire period, kit and delivery address you give us. A booking is only confirmed once we have confirmed availability in writing (or by text/WhatsApp) and, where applicable, received payment or a deposit.
3. Payment
- Payment terms are agreed at booking — full payment, deposit or account terms for regular trade customers.
- Where a deposit is taken, the balance is due by the date shown on your confirmation, normally before delivery.
- Overdue amounts may result in further hire being refused until cleared.
4. Hire period and extensions
- The hire period runs from delivery (or collection) until the agreed return time.
- If your job overruns, call us before the hire ends. If the kit isn't booked out again we will usually extend it at the agreed daily rate.
- Kit returned significantly late without agreement may be charged at the daily rate for each extra day.
5. Delivery and collection
- Delivery within Hyndburn is free; further afield a delivery charge is quoted up front and never added afterwards.
- You must provide safe, legal access for delivery and collection. If we cannot reach the agreed spot we will agree an alternative with you at the time.
- Someone aged 18 or over must be present at delivery for the walkthrough.
6. Care of equipment and fuel
- Kit leaves us checked, serviced and fuelled. It must come back in the same condition, fair wear and tear excepted.
- Fuel used during the hire is your responsibility; we agree the fuel position at delivery so there is nothing to argue about at collection.
- You are responsible for the kit from delivery until collection. Do not leave it unattended in a public place.
- Any loss, theft or damage beyond fair wear and tear is chargeable at repair or replacement cost, supported by evidence and invoices.
7. Operation, licences and suitability
- Every hire includes a walkthrough at delivery: starting, safe operation and shutdown.
- Van drivers must meet the age, licence, driving-history, occupation and insurance conditions shown on our driver requirements page.
- Every proposed van driver must provide the requested identification and consent to a manual DVLA licence check before the booking is confirmed.
- Equipment must be used for its intended purpose, in line with the walkthrough and any instructions. Misuse voids any cover and is chargeable.
- Our equipment is hired for private and light-trade use; for specialist or heavy industrial applications, tell us before booking.
8. Cancellation by you
Cancellations must be made by phone or in writing. Deposits are non-refundable where we have held kit specifically for you. Where cancellation is received close to delivery, or the van or machine has already been prepared, part or all of the hire charge may remain payable, as set out in your confirmation. We will always try to re-let the kit and refund what we reasonably can.
9. Cancellation or changes by us
We only cancel in exceptional circumstances — for example mechanical failure, accident, severe weather or anything else outside our reasonable control. If we cannot supply the kit we will try to source an equivalent, or refund in full anything you have paid, including any deposit. Our liability in those circumstances is limited to the total amount you have paid to us.
10. Insurance
We hold public liability insurance and our equipment is insured as a business. Copies of current certificates are available on request. Customer's own property and works are your responsibility; check your own insurance covers hired-in plant on your site.
Advertised van hire prices include van insurance, breakdown cover, mileage, VAT and the option to add one additional eligible driver. Cover remains subject to every driver passing the stated eligibility and licence checks.
11. Photography
We occasionally photograph kit at work for our website and social media. We will not publish images in which you or your property are identifiable without your permission, and you can withdraw that permission at any time by contacting us.
12. Complaints
If something goes wrong, tell us at the time if you can — a call on the day lets us fix most things immediately — and contact us in writing within 14 days. We will acknowledge within 5 working days and aim to resolve matters within 28 days.
13. Liability
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited. Subject to that, our total liability arising from a hire is limited to the total charges paid for that hire, and we are not liable for indirect losses such as loss of profit or delay to your works.
14. Governing law
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
